The Tianfu New Area Court, embracing the principle of “Full Partipation as if It Were My Litigation”, has established a Litigation Guidance Center within its dedicated litigation service hall. This center operates with a specialized team structured on a “1+N” model: one case filing review officer supported by multiple case filing advisors. The team is committed to effectively assuming “five distinct roles” and fulfilling “five-dimensional responsibilities”. This approach aims to maximize the “front-end window effect” at the pre-litigation stage, ultimately enhancing the overall experience for businesses and individuals engaging with the legal system.
I. Enhancing the “Consultant” Role for Precise Case Routing.
The court has developed a progressive service mechanism that combines “litigation guidance” and “case filing assistance”, tailored to satisfy the needs of visitors seeking legal services. This system addresses inquiries related to court procedures, case filing, hearings, mediation, and other legal matters. A stratified guidance process has been implemented to ensure accurate routing of cases. Within the case filing assistance area, which can accommodate up to 40 individuals in a queue, three specialists provide face-to-face consultations simultaneously. This approach has boosted the center’s daily service capacity to an average of 150 inquirers, demonstrating improved efficiency and accuracy in case routing.
II. Strengthening the “Quality Assurance” Role for One-Time, Comprehensive Initial Guidance.
To streamline the case filing process, the court has standardized its service verification and feedback procedures. Key resources such as the Case Filing Guidelines, Litigation Document Templates, and Model Civil Complaint and Defense Forms have been published to assist litigants. The court enforces uniform standards for “one-time, comprehensive notifications” across both online and offline platforms. A four-step “quality assurance” method for case filing materials has been implemented, which encompasses the “jurisdiction verification”, “essential elements check”, “optimization of supporting documents”, and “supplementary information provision”. This refined process has significantly reduced case filing times, with the fastest now completed in under 10 minutes, substantially decreasing wait times for parties involved.
III. Enhancing the “Liaison Officer” Role to Facilitate Mediation and Compliance.
The court has established an integrated mechanism linking litigation guidance with mediation, case filing, trial confirmation, court trial, and enforcement. This approach effectively promotes pre-litigation alternative dispute resolution, leading to the successful resolution of 2,610 disputes before they reached the court. The system actively encourages parties to promptly fulfill monetary obligations stipulated in mediation agreements, with over 200 Voluntary Compliance Certificates issued to date. The court has also refined its case filing early warning and inter-departmental consultation processes. A list of priority case types has been clearly defined, enabling the production of 15 major information briefs on significant case filings. Additionally, 14 consultations have been conducted on critical issues such as potential bankruptcy filings, contentious cases, and enforcement feasibility.
IV. Strengthening the “Risk Notifier” Role for Litigation Risk Awareness.
The court has intensified its efforts to prevent dishonest litigation by developing three types of risk notification templates: Litigation Risk Notice, Judicial Risk Notice for Non-Compliance with Effective Judgments, and False Litigation Risk Notice. These notices proactively alert litigants to nine major categories of legal risks across various stages of litigation, such as false litigation, erroneous property preservation, and obligations to comply with court judgments. This year alone, the court has issued 15,390 risk notices, achieving a year-on-year decrease of 27.41% in the enforcement rate for civil judgments.
V. Enhancing the “Facilitator” Role for Pre-Litigation Judicial Clarification.
The court has effectively transitioned from a management-centric to a service-oriented approach by expanding the explanatory and analytical functions of the Litigation Guidance Center. This enhanced role focuses on providing case-specific legal explanations and conducting relevant case law searches, taking into account both the details of each case and the psychological state of the parties involved, and assisting litigants in making informed decisions about their rights protection strategies. As a result of these efforts, 2,058 potential litigants have been guided to withdraw their lawsuits before formal filing this year. Additionally, the court has strengthened its ability to identify and respond to potential petition risks. By effectively addressing emotional tensions, it has successfully prevented over 10 mass disputes from escalating into formal petitions prior to litigation.
